I assume all risks of participation in any and all activities associated with the Program, including, without limitation, any risks that may arise from active or passive negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. In consideration of my child’s application permitting him or her to participate in the Program, I hereby agree for myself, my child, and each of our executors, administrators, heirs, successors, next of kin, and assigns as follows: (a) I waive, release and discharge from any and all liability Pouting Pandas, Experience Language Studios, Napa Unified School District, and any instructors, employees, agents, owners, directors, officers, representatives, volunteers and other persons associated with any of the foregoing or with the Program (collectively, the “Releasees”). (b) This release is intended to be enforceable to the fullest extent under California law (excluding the fraud or willful misconduct of the Releasees) and extends, without limitation, to the active or passive negligence or fault of the Releasees for all liability, including liability for death, disability, personal injury, property damage, theft, lost profits or income, or actions of any kind which may hereafter occur to me or my child, including traveling to or from the Program. (c) I agree to indemnify, hold harmless, and promise not to sue the Releasees from any and all liabilities or claims made as a result of my child’s participation in the Program, whether caused by the active or passive negligence of Releasees or otherwise. I acknowledge that none of the Releasees are responsible for the errors, omissions, acts, or failures to act of any other Releasees or of any other person, party or entity. I understand injuries or accidents related to my child's consumption of food or drinks, (including lunch, snacks or rewards) is not the responsibility of instructors supervising children during, before or after official class times. I understand the instructors are not responsible for my child's injuries on the playground or playing with other children during, before or after official class hours. It is my responsibility to drop off my child when class starts and pick up my child when class ends to ensure the safety of my child. I understand photos and videos may be taken for class related activities or promotional purposes for Pouting Pandas, Maker Camp, Experience Language Studios, Vichy Elementary, the Napa Unified School District and other program affiliates. I certify that I have read this release and I fully understand its content. I am aware this is a release of liability and a contract and I sign I on my behalf and on behalf of my child of my own free will.

Please notify us in advance if you decide to cancel. This will help us open space up for other children and also not charge parents who need to cancel due to scheduling conflicts. Thank you!
